    Title: Complicated issue regarding taxes

    Question: My father has died few years ago and we are a family of 8 (6 brother, 1x sister, and mother). Our wealth are all shared between all of us. We have not separated our shares left from our father wealth. 5 members of our family live in the UK. 3 Members of our family live outside UK in another country. We run a business in the UK and pay all the taxes but the issue is that only 4 members out of 8 are registered to do business here in the UK because other 3 members who lives outside UK cannot come here therefore cannot be registered as a business partners yet we pay their taxes as well. We would have pay less tax if all 8 members were registered in the UK. Because all of our money are shared and by end of each year we divide all the profit equally, is it permissible in Islam to calculate taxes as if they are also here in the UK because the money we have invested in the UK has share of all family members.

    (Fatwa: 159/159/SD=03/1437) In the question mentioned above, if the family members, whose names are not registered as business partners, equally share the business activities and receive their share in the profit of the business then they shall also pay their share of income tax. The ruling shall not differ if merely their names are not registered. Whatsoever amount is paid in income tax it shall be divided among all the partners. قال الكاساني : إذا شرطا الربح على قدر المالين متساويا أو متفاضلاً ، فلا شك أنه يجوز ، ويكون الربح بينهما على الشرط سواء شرطا العمل عليهما أو على أحدهما والوضيعة على قدر المالين متساوياً ومتفاضلا ؛ لأن الوضيعة اسم لجرء هالك من المال ، فيتقدر بقدر المال .... (بدائع الصنائع : 5/83 ، كتاب الشركة ، ط: زكريا ، ديوبند) قال في الهندية : إن الربح بينهما على الشرط والوضيعة أبداً على قدر رؤؤس أموالهما ، كذا في السراج الوهاج .
