Title: Talaaq on phone

Question: My husband divorced me thrice on phone. My parents also witnessed this. Have I been divorced? I have been living separately from him. What is my marital status? Am I divorced?

(Fatwa: 1309/1295/L=11/1436) If your husband confirms that he has given you three talaqs then all the three talaqs occurred on you and you became mughallaza baina (irrevocably divorced) and became haram for your husband. However, in case your husband denies having given the talaqs then it cannot be solved from Darul Ifta, rather it should be taken to local Shariah Panchayat. It is to be noted that if you have heard him giving three talaqs by your ears clearly without any doubt then now it is not lawful for you to give him control over you. You should try to get rid of your husband through talaq or khula.
