Title: tayammum after nightfall

Question: If a person wakes up with only 5 minutes left for Fajr prayer and when ghusl is wajib is it permissible to pray Fajr with tayammum or first do ghusl and make qaza during ishraq.

(Fatwa: 719/574/D=07/1436) It is not lawful to perform tayammum merely due to the shortage of time. One should offer salah after performing ghusl and in case time is over, then he should perform salah as qaza. وفي الهندية: الأصل أن كل موضع يفوت فيه لا إلى خلف فإنه يجوز له التيمم وما يفوت إلى خلف لا يجوز له التيمم (1/85 ط: اتحاد بکڈپو) فتاوى محموديه 5/184 ط دارالمعارف، فتاوى دارالعلوم 1/331). However, some Ulama allow to offer salah by tayammum at such occasions and later he should perform qaza of that salah after ghusl. وفى الدر: ولا يتيمم لفوت جمعة ووقت ولو وتراً لفواتها إلى بدل وقيل يتمم لفوات الوقت قال الحلبى فالأحوط أن يتيمم ويصلى ثم يعيد ورجحه الشامى (رد المحتار 1/413 ط زكريا، آپ کے مسائل 3/129 ط نعیمیہ جدید)
