Title: I want to ask about fajr (morning salah) and qadha of sunnah?

Question: I want to know that if a person arrives late in the Fajr prayer (morning) and feels that if he reads sunnah namaz the fardh namaz with jamah will be over, then will he join jamah or not. If he joins then can he read the left out sunnah of Fajr after the jamah is over though there is still enough time before tulu aftab.

(Fatwa: 5/8/N/=01/1435) (1) If one is sure that he could not join the imam in qadah if he offers the sunnah of Fajr then since the fardh salah is more important than the sunnah, so he should give up the sunnah and join the jamah. قال فى الدر (مع الرد 2:510 ط مكتبة زكريا ديوبند): وإذا خاف فوت ركعتي الفجر لاشتغاله بسنتها تركها لكون الجماعة أكمل .... اهـ وانظر الرد أيضا . (2) One should not offer the sunnah of Fajr after the fardh salah of Fajr though there is more time in rising the sun, it is not lawful, rather it is makrooh tahrimi. قال في رد المحتار (2: 512): وأما إذا فاتت وحدها فلا تقضى قبل طلوع الشمس بالإجماع لكراهة النفل بعدالصبح اهـ وقال فى الدر (مع الرد 2: 36،37): وكره نفل قصدا ولو تحية مسجد وكل ما كان واجبا لا يعنيه بل لغيره .....، والذي شرع فيه في وقت مستحب أو مكروه ثم أفسده ولو سنة الفجر بعد صلاة فجر .... اهـ وفى الرد: قوله: وكره نفل الخ: ..... والكراهة هنا تحريمية أيضا كما صرح به فى الحلية’ ولذا عبر فى الخانية والخلاصة بعدم الجواز، والمراد عدم الحل لا عدم الصحة كما لا يخفى اهـ
