    Title: Talaq

    Question: My brother has given talaq to his wife three times at one meeting. He said talaq three times and the way he followed is like this "main Allah ko hazir o nazir mante hue tumhe talaq deta hun, talaq deta hun, talaq deta hun” and also he sent this thing in written form along with iddah money in the form of DD of 4000 rupees. But his wife did not accept that letter. So I want to know whether talaq took place or not as some of my friends told that 3 times talaq at one time is considered as one.

    (Fatwa: 1393/1014/D=1433) If your brother admits giving three talaqs or there are Shariah evidence then all the three talaqs took place and she became irrevocably divorced (mughallazah bayina) and their nikah was terminated. The divorced woman shall become free after completing her iddah, and she can marry anyone except her previous husband. Whether the wife accepts the talaq or not talaq took place in each case. Her refusal to accept the talaq nama has no adverse effect. What your friend says that only one talaq took place it is against the Quranic verses, hadith, ijma of Sahaba and Ayimma Mujtahidin. It is wrong and shall not be accepted in any case. As three talaqs have taken place so now she cannot live with her previous husband without Shariah halalah.
