Question: Assalamo Alaikom, if someone steals something from a company but take it back and boss of the company says "let's share it! give me half and you keep half." can he keep it and is it halal for him?

(Fatwa: 420/D-120/K=1431)

If the boss is authorized by the company or he is the owner of it, then keeping it is halal and lawful otherwise not.

قال في الشرح التنوير: لا يجوز التصرف في مال غيره بلا إذنه ولا ولايته إلا في مسائل مذكورة في الأشباه . (الدر المختار مع رد المحتار 9/291).
