Question: If a husband saying that he said three words of divorce to his wife in front of his wife's father and his relative but his wife and father-in-law not accepting this fact that he said this three words of divorce in front of him so this divorce will be valid or not.

(Fatwa: 1182/764/L=9/1434) In the question mentioned above, when the husband confirms to give three talaqs then all the three talaqs took place on his wife, no matter whether the wife and father in law accept it or not.

Q. I was engaged to Mushtaq Ahmad Shah and the Nikah was performed on 04-03-2004. However the marriage ceremony (on which zafaf/ Rukhsati that takes place as per custom) has not taken place till today because of the rude, cruel and inhumane behaviour of the to be husband (Mushtaq Ahmad Shah). I approached directly and indirectly (through various Islamic Institutions i.e, Darul Uloom) to him for talaaq/khulah so that I would get free from his clutches. However he is neither giving talaaq nor compromising for khulah. Instead he threatens that he will neither give talaq nor khulah till life. Due to his bad and mischievious treatment, he has not only hurt me physically but also mentally/psychologically and undoubtedly it is not possible for me to live a happy and peaceful married life with him in future. As such it is requested please guide me in the light of Shariah regarding following point. 1. What I can do if that rude and rough person is not ready to give talaaq nor is compromising for khulah. 2. Under such conditions, what action can I take to get rid of him. What are the various options and implications? 3. Q. Can you please get clarified my following masla from Mufi sahib. I have been married for 2 years. For the last two months there has been quarrel with my wife on very small issues. Actually, my parents stay in a village and I stay with my wife in a city where I do job. We generally visit my parent 2-3 times in a year for 5-7 days. Recently, when we were at my parent place on a small issue my wife told -"Mujku thumharey maa baap ki zarorat nahi". I got anger and replied -"phir mujku bhi teri zaroorat nahi.". This happens two times. After that I left her at her parents' place. Presently, now and then on phone we start fighting and in anger I used to tell words like -" Hum doono ko nahi ban rah hai", "tho jaa"..etc. I never uttered any word like "talaq". I have following 4 questions- 1. Will the words I told to my wife going to impact my Nikha? 2.Sometimes it comes to my mind to give talaq to my wife, but actually I do not want. And there is always something like wasawasa in my mind that I told talaq in my mind, but I never uttered any word from my mouth even when I was alone. Will this effect my nikha? 3. Q. I was married on Feb 16,2003 and came back to Arab for job to-date I did not go to India due to my job and passport problem. Allah bless us baby boy on Dec 20,2003. In Feb 2004, I lost the job and my inlaws started blaming me that I am married in Saudia. I sent to my wife money several times till June 2004 but after that she refused to take money, the reason was wrong concept of my marriage. Her African uncle promised me to send wife/ son to me. She talked nicely from Nov 7 to Dec 2 2006. And suddenly she filed a in Jamiat Ulema Africa for Khula. The main point the wife raised that I am not in touch with her for three years and neither send her money. (Is her maintenace claim valid if she is running here/there in different countries without informing me). They are denying any conversation between Nov 7,2006 to Dec 24,2006 by saying that the voice can be developed on computer in fraud way. The last money I sent her on Aug 6, 2005 because after that she refused to accept. She want to keep son with her. My question is that on this ground our nikah will remain valid or it will finish.
