    Title: loan from bank

Question: I do not want any help from my family, what I meant that the few years back once a bank harassed us for payment I mean you know their calls and their repeat visits that I was saying. Actually I do not want any help from my family, the reason I told you about my family is that they will not help me because I am revert in Islam and they are not supportive about this. And our loans are so much, we do not even have our own house, my husband works and fulfills our needs, but to pay that high loans and cards is not possible (Allah knows best). I am telling you, in case of death happens, and there is no one to pay on our behalf, as no friends, family, relatives, no one, we do not have any one to help us except Allah. So I was a bit worried, that due to all this circumstances. I wanted to ask you, a person has such big amount of loan and does not have money to pay off, and there is no one to pay off in case they are dead and Allah Knows best. I wanted to ask, they are now getting to know this is that hadith which says that loans has to be paid off! What should I do, I am worried, since the amount is big and I do not know how can I pay? And in case I am not able to pay off then what, Allah knows best. Please help what can be done in such situation?

    Bismillah hir-Rahman nir-Rahim !

(Fatwa: 382/L=218/TL=1433) If you had to take the loan in exigency and severe compulsion with the intention to pay it off but after much efforts you could not pay it off and died then it is hoped that Almighty Allah shall not take you accountable in the hereafter for the same. It is mentioned in hadith: من أخذ اموال الناس يريد اداءها ادى الله عنه ومن أخذ يريد إتلافها أتلفه الله عليه . As for the hadith which says that a person shall not enter into jannah who took loan and could not pay it off and died in the same state, Ulama have explained it as a loan taken without any need and spent in extravagance, so such a debt will stop the soul of momin to enter in paradise. However, the loan which was taken for reasoable needs and the debtor could not pay it off due to some compulsion then such loan shall not stop the soul of momin from entering into paradise. However it is necessary for a Muslim to leave no stone unturned to pay his debt off: قيل الدائن الذي يحبس عن الجنة حتى يقع القصاص هو الذى صرف ما استدانه في سفه أو سرف وأما من استدانه في حق واجب كفاقۃ ولم يترك وفاء فان الله تعالى لا يحبسه عن الجنة إن شاء الله تعالى [مرقات 104 جلد 6] Also both of you should keep on reciting the following dua extensively: اللهم اكفنى بحلالك عن حرامك وأغننى بفضلك عن من سواك . In-sha-Allah, Almighty Allah surely would let you any way out to pay your debt off.

Allah (Subhana Wa Ta'ala) knows Best
