Title: Accidental death claim

Question: I am a widow. I lost my husband in a car accident. He was a professor. He hired a car and he was going to Delhi. He was sitting behind the driver. Unfortunately, his car collided with a truck. My husband lost his life and there were minor injuries to the driver. The driver is claiming that the fault was of truck driver. But we are not sure. Can we file a case to claim the compensation amount under third party insurance.

If you are sure that it was not truck driver’s mistake then it is not lawful for you to file a case and demand amount from the insurance company.
