Question: As I am in urgent need of Rs 5 lakh can I give my mango plantation for a period of 8-10 years under the agreement that after the specified period he is to return the plantation to me and I as per the terms of the agreement, shall not return his money back to him and also under the agreement he has to give me a specified amount of fruits yearly.

(Fatwa: 366/409/N=1433) The case mentioned in the question is categorized as bai (sale) and in sale it is necessary that mabi’ (commodity) is available and defined. So it is mentioned in the books of Fiqh. But here the case is not so, as mabi i.e. mangoes are no longer available and its quantity is not known and fixed; hence this dealing is not lawful as per the Shariah.
